Terms of Service

The agreement between you and Sites That Grow when you use the Service.

These Terms of Service (“Terms”) govern your access to and use of sitesthatgrow.comand the Sites That Grow client portal (together, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Who we are

“Sites That Grow,” “we,” “us,” and “our” refer to the design and engineering studio operating under the Sites That Grow brand. Reach us at hello@sitesthatgrow.com.

2. Eligibility & account

The Service is invite-only. To use the portal you must be invited by Sites That Grow and accept the email invitation. You're responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Services we provide

We provide design, engineering, and ongoing improvement services scoped per engagement. The specifics — deliverables, timeline, pricing — are agreed in writing for each project or care plan before work begins.

Care plans

Care plans are recurring monthly subscriptions billed through Stripe. Each plan includes a defined block of monthly improvement hours plus baseline maintenance. Hours reset on the 1st of each calendar month and do not roll over. You can change or cancel your plan at any time from the billing page; cancellations take effect at the end of the current billing period.

Project work

One-off project work is invoiced separately, in advance or on milestones, with terms stated on each invoice. Standard payment terms are Net 14 unless otherwise agreed. Invoices not paid within 30 days of the due date may pause active project work.

4. Payments & refunds

Payments are processed by Stripe. By providing payment information you authorize us (and Stripe) to charge the agreed amounts. Subscription fees are non-refundable except where required by law. Invoiced project fees are non-refundable once the corresponding work has begun; if you cancel mid-project, you remain responsible for work performed up to the cancellation date.

5. Intellectual property

Your content. You retain all rights to content, data, and materials you provide to us (logos, copy, brand assets, etc.). You grant us a limited license to use them solely to deliver the Service.

Deliverables. Upon full payment, custom deliverables produced for you (code, designs, content) become your property, except for any third-party libraries, fonts, or tools subject to their own licenses.

Our background IP. Reusable patterns, internal tooling, and templates that pre-existed your engagement remain ours. We may reuse them across other clients.

Portfolio rights.Unless explicitly agreed otherwise, we may showcase work we've done for you (project screenshots, summaries, case studies) on our website and in marketing materials.

6. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or abusive purposes
  • Reverse engineer, scrape, or attempt to gain unauthorized access
  • Upload malware or content that infringes third-party rights
  • Resell or sublicense access to the Service without our written consent

7. Confidentiality

We treat any non-public information you share with us as confidential and use it only to deliver the Service. We expect the same in return: information shared in the course of our work (pricing, processes, internal tools) is to be kept confidential unless made public by us.

8. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Sites That Grow's total liability for any claim arising from these Terms or your use of the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Termination

You may close your account or cancel your care plan at any time. We may suspend or terminate your access if you violate these Terms or fail to pay outstanding invoices, in each case after reasonable notice (except where prompt action is required to protect the Service or other clients).

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email to active clients with at least 30 days' notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Sites That Grow is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction.
